The matter of an Osun State High Court Judge, Justice Folahanmi Oloyede over the dismissal of her petition by the Osun State House of Assembly yesterday suffered setback before an Osogbo High Court as her application with affidavit of urgency was not heard by the judge.
Counsel to Justice Folahanmi Oloyede , Mr. Lukman Ogunsetan had on Monday filed a motion exparte supported by an affidavit of urgency, seeking an order of the court to file an application for an order of certiorari to quash the recommendations of the Osun State House of Assembly Ad-hoc committee that dismissed her petition.
But since the judges in Osun state Judiciary are on their annual court vacation, the matter was automatically assigned to the only vacation judge who would usually sit in periods like this to attend to exigent cases.
However, the counsel and his client were disappointed as they sat through the period of proceeding at Court 4 presided over by Justice A.A Aderibigbe without the case getting a mention.
Justice Aderibigbe announced to the court that his next sitting date would be Thursday next week.
After he rose, the anxious lawyer, Lukman Ogunsetan sat alone behind in the court room, thinking the court would reconvene to attend to the application which was an exparte motion that did not require the other party to be put on notice.
But after about three hours, Mr Ogunsetan came out of the courtroom with an obvious look of confusion.
When journalists approached him, the counsel expressed worry about the attitude of the court to the application which he said had been filed since Monday.
The lawyer said the tactical delay in hearing the application would compromise fairness and justice in the whole process, as the Judicial Service Commission had already issued query on Justice Oloyede which she is expected to respond to within seven days, terminating on Monday next week.
