Chairman of Akwanga local government council of Nasarawa State, Honourable Abashiya Kwato of the All Progressives Congress, APC has been dragged to a Nasarawa State High court sitting in Keffi over alleged manipulation of election result.
In a suit filed by Hassan Gwamna, also of the APC, the plaintiff is challenging the candidature of the chairman on the ground that he was not validly elected and nominated candidate of the party during the February 8th 2014 primary election for the chairmanship election for Akwanga local government.
The plaintiff who claims to have won the said party primaries is praying the court for an order directing the first respondent to vacate the office of the chairman of the local government and that the he (plaintiff) should be immediately sworn in as the validly nominated chairmanship candidate of the second respondent (APC).
In an originating summons, the plaintiff is also praying the court to “declare that the act of the 2nd (APC) respondent forwarding the name of the first respondent as its chairmanship candidate to be sponsored for election as scheduled instead of the name of the plaintiff was wrongful and contrary to law.
“A declaration that the 3rd (Nasarawa State Independent Electoral Commission) acted in contravention of law when it accepted the name of the first defendant forwarded to it by the 2nd defendant as its chairmanship candidate contrary to the knowledge and record of the 3rd defendant that the plaintiff was the validly elected and nominated chairmanship candidate of the 2nddefendant”.
When the matter was brought before Justice Audu Bako of the High Court l, Kefifi, the lead counsel to the plaintiff, Vincent Ofikwu informed the court that they were served memorandum of appearance by the first defendant but that the 2nd and 3rd defendant were yet to do so.
Justice Bako therefore adjourned the matter to 2nd -3rd November for hearing.
