Suit challenging the defection of the member of Benue State House of Assembly, Hon Nick Odukelaho Eworo was struck out by Justice Adam Onum of Makurdi High Court yesterday as he said, “By law no one can force any person to join a political party.”
The judge who ruled on the preliminary objection against the suit filed by the defendant’s counsel, Professor Tony Ijohor, SAN said PDP has no standing to challenge the action of the state Assembly even in relationship to the appointments to be brought which touch on principal officers by virtue of Section 6 Sub Section 4 of the Standing Rules of the Assembly.
He maintained that the court has no jurisdiction over issue of membership of a political party but added that the plaintiff did not disclose any cause of action against the defendant.
He submitted that under law, no one could force any person to join a political party and averred that APC which is a necessary party in the suit was not joined as a defendant by the PDP and as such struck all the reliefs sought, which touched on the interest of the APC.
