Trial of the founder of DAAR Communications Plc, Chief Raymond Aleogho Dokpesi on alleged N2.1 billion arms deal was yesterday stalled owing to the eligibility of additional proof of service filed by the Economic and Financial Crimes Commission, EFCC.
At the resumed trial yesterday, Dokpesi’s counsel, Chief Wole Olanipekun, SAN, complained that the additional proof of evidence served on the defendant by the prosecution was so faint that it could hardly be read to prepare a good defence for his client.
Chief Olanipekun, who led three other Senior Advocates of Nigeria, SANs, comprising of Chief Kanu Agabi, Mike Ozekhome and Dayo Adelaja, told the trial Judge, Justice John Tsoho that it will take binocular equipment to read the processes served on him by the EFCC.
Chief Olanipekun told the court that the implication of the poor quality of the EFCC papers was that Dokpesi’s legal team will not be able to make use of the documents for the defence.
Besides, Olanipekun claimed that the additional proof of evidence was not validly before the court because the EFCC counsel, Rotimi Jacobs, SAN, did not obtain leave of the court before filing it and as such, the evidence is not competent.
However, the defence counsel, Rotimi Jacobs, SAN, in his own submission told the court all the processes served on the defendant were legible and wondered why the defence is making issue out of it.
Mr. Rotimi claimed that the documents of the prosecution were served on the defence a week ago and that, as senior counsel, they ought to have drawn his attention to their complaint for him to give remedy.
Jacobs latter agreed to serve the defendant a clean copies of the processes for the trial to proceed and to avoid dissipating energies on a minor issue.
After consultation by the prosecution and the defence, Justice John Tsoho adjourned the matter to April 28 and 29 for commencement of trial.
