EDO state governorship Elections Petitions Tribunal sitting in Benin city, will today, Thursday commence the pretrial hearing in the case filed by the Peoples Democratic Party, PDP, governorship candidate, Osagie Ize-Iyamu, against Independent National Electoral Commission, INEC, the APC and Governor Godwin Obaseki. The PDP and Pastor Ize-Iyamu are challenging the declaration of Mr Godwin Obaseki of the All Progressives Congress, APC, as the winner of the September 28 Edo governorship election by INEC. They are asking the tribunal
to nullify the result and instead declare Ize-Iyamu as the winner of the said election. However the APC and Mr. Obaseki have urged the tribunal to discountenance PDP’s petition and uphold their application which challenged the areas where PDP is claiming victory. On October 11, the tribunal ordered INEC to allow PDP have unhindered access to all electoral materials used in the September 28 governorship election for purposes of inspection. This order followed an exparte motion filed by the PDP’s counsel, Mr. Kingsley Obamogie, who argued that the motion was in compliance with section 151 of the Electoral Act, 2010 as amended. The All Progressives Congress and the Peoples Democratic Party in Edo State later disagreed on the modalities for the inspection of electoral materials, following a suit filed by the APC challenging the scanning of ballot papers by the PDP. The three-member tribunal led by Justice A. Badamasi, after a demonstration of the devices which the PDP wanted to deploy for the inspection and scanning of the electoral materials later gave the party the nod. It then went on to fix today Thursday, December 1 for the
commencement of the pre-trial hearing in the petition. Earlier the governorship election petition tribunal also granted the motion exparte to the Peoples Democratic Party (PDP) and the Young Democratic Party to serve All Progressives Congress (APC) and Mr Obaseki, petitions by substituted services. This followed their prayer to the tribunal for leave to serve the respondents by pasting the petitions and all other processes on the wall or door of the last known addresses of Edo state APC secretariat along Airport road, Benin City, and No.8 Commercial road, G.R.A, BeninCity, Edo state.
