Immediate past Benue State Governor, Gabriel Tor Suswam has discontinued his case against Senator Barnabas Gemade.
Counsel to Suswam, Andrew Wombo, who brought the withdrawal through an application said, “My client has decided to withdraw the case for the interest of peace and harmony of the society.”
He prayed the court to grant the application and not to award cost against his client.
Lead counsel to Gemade, Barr Vincent Uji did not oppose the application for withdrawal of the case but requested for N5million cost against Suswam for their logistics.
“We are not opposed to the motion. We are asking for N5million cost to be awarded to us because we conducted several researches and filed processes. We did not ask the petitioner to withdraw his petition”, Uji said.
The tribunal chairman declared the case closed for the interest of peace and harmony and did not award cost to Gemade.
Meanwhile, defeated All Progressives Congress, APC senatorial candidate for Benue South senatorial district, Daniel Onjeh who is contesting the re-election of the President of the Senate, David Mark at the Election Petition Tribunal sitting in Makurdi, has expressed worry over the manner the Independent National Electoral Commission, INEC is frustrating their case.
When the matter between Sen. Mark and Onjeh came up yesterday, counsel to Onjeh, Adetunji Oso said they had applied to inspect materials used during the election since April 14, 2015 but regretted that INEC has continued to trick them.
Oso therefore sought permission of court to compel the electoral body to allow his client access to the materials.
However, counsel to INEC, G.S. Manswa said that it has been difficult for them to make the materials available to the petitioner for inspection owing to the enormity of the election which covered nine local government areas.
The tribunal chairman, Justice Mosunmola Dipeolu adjourned the case to June 12, 2015 for further hearing.
While speaking with newsmen after the court session, Onjeh who said he is contesting the re-election of Mark on grounds of irregularities, alleged connivance by INEC to unnecessarily delay the case as well as subvert justice.
He argued that INEC had even declared Mark winner of the election before the conclusion of voting.
