Election petition tribunal sitting in Bauchi State has nullified the election of the member representing Sade constituency in the State House of Assembly, Baba Madugu of the All Progressives Congress, APC.
Delivering her judgment, yesterday, Chairman of the tribunal, Justice Hajara Tani Dami Gwadah, said the evidence presented before the tribunal showed that the first respondent, Madugu, was not duly elected or returned by majority of lawful votes cast at the last general election for Sade constituency.
She said having calculated the number of votes cast, the petitioner scored 9,233 votes against the first respondent’s 7,354, therefore the petitioner is the undisputed winner of the said election and is entitled to a certificate of return.
She explained that the first petitioner ought to have been returned as the duly elected member for Sade constituency, judging by the result obtained from the third respondent’s forms EC8A and Forms EC8B respectively and ordered INEC to withdraw the certificate of return issued to the first respondent and issue same to the petitioner who scored the majority votes cast.
The tribunal, however, ordered its ruling at no cost, saying the parties should bear their cost.
