FEDERAL High Court sitting in Ado-Ekiti yesterday dismissed an application filed before the court for stay of execution of the judgement delivered on Ekiti State governor, Ayo Fayose, and the Zenith Bank. The presiding judge, Justice Taiwo Taiwo said that the application filed by the
Economic and Financial Crimes Commission, EFCC, to stay the execution of the judgement lacked merit. The EFCC filed an application at the Federal High Court in Ado-Ekiti on December 15, 2016, seeking a stay of execution of the judgement delivered by the court on the frozen account of Governor Fayose pending the determination of the Appeal Court.
However, Justice Taiwo averred that “once a judgement is being executed, you cannot stay the execution again.” The judge, referring to Section 308 of the 1999 Federal Republic of Nigeria, averred that there was no substantial points raised in the affidavit for the court to condemn the judgement already delivered by the court. He therefore dismissed the application for lacking merit.
