Comrade Mohammed Ali, the executive chairman of Dekina Local Government Area of Kogi State who was impeached but reinstated by the High Court of Justice sitting in Anyigba in Kogi State on Frida, resumes today after over one year out of office.
The reinstated chairman who, was besieged by his teeming supporters after the court verdict at the premise of the High Court at Anyigba, commended the judiciary for a job well done.
While he averred that he had grudges against no one over his purported impeachment since over one year ago, he assured his supporters that the ugly experience would spur him to do more for the people of council.
Although he said the time was a bit short for him to translate the way he had wanted the council to be, Comrade Ali assured that he would create an enabling environment that would kick off certain people-oriented development that had never been witnessed in the council.
Delivering judgement over the originating summons filed by him on October 10, 2014, Justice R.O Ayoola of the High Court, Anyigba, declared that any sitting or session of the second defendant (Kogi State House of Assembly) as well as any proceedings conducted outside the second defendant’s designated legislative chamber located within the premises of Dekina Loca Government secretariat which led to the impeachment of Comrade Mohammed Ali was illegal, null and void and of no effect whatsoever.
Explaining further,r Justice Ayoola ruled that among other reasons, the defendants failed to comply with the procedures laid down in section 16 subsections(2)-(6) of the Kogi State Local Government laws, 2008 (as amended) before presenting application to the 10th defendant (vice chairman of Dekina Council)to constitute a panel to investigate the purported allegations of gross misconduct against Comrade Ali.
She declared that failure to serve the claimant (Ali) with a copy of relevant notice of allegations as required by sections16(3) of the Kogi State Local Government Law, 2008 (as amended) was a gross violation of fundamental right to fair hearing and an affront to the principle of natural justice.
She therefore declared a consequential order to that effect by setting aside the purported impeachment of the claimant (Ali) with all the proceedings relating with it, and ordered the restoration of the claimant to his position as the substantive chairman of Dekina
