THE GOVERNORSHIP election petition tribunal sitting in Lafia, the capital of Nasarawa has granted the leave sought by counsel to Mr. Labaran Maku and governorship candidate of the All Progressives Grant Alliance, APGA in the just concluded governorship election in the state to inspect and obtain the Certified True Copies, CTC of all polling documents, electoral and other materials in custody of INEC before the pre-hearing session.
Maku had approach the tribunal, challenging the declaration of Governor Umaru Tanko Al-Makura and candidate of the All Progressives Congress, APC, by INEC as winner of the governorship election held on 11 April, 2015. He alleged that the exercise was marred by massive rigging, intimidation of voters, among other irregularities.
Ruling on an ex-parte application and a 4-paged written address filed by Mathew Burkaa alongside H.A Ibrahim, counsel to the respondent, chairman of the tribunal, Justice H.S Mohammed ordered INEC (3rd respondent) to make available for inspection by the applicants, ballot papers, ballot materials and other electoral materials used by the 3rd respondent for the conduct of the April 11 governorship election.
Also granted was a leave of the tribunal permitting 1st respondent’s forensic expert(s) to inspect by way of machine/electronic scanning, all ballot papers and other electoral materials used for the conduct of the governorship election in the state.
The tribunal further granted a leave permitting hand-written and forensic expert(s) to conduct an inspection of INEC’s forms EC8A, EC8B, EC8E and all other forms, ballot papers used in the election.
“That an order directing the 3rd respondent to forthwith produce on polling unit basis or otherwise all the ballot papers, all the ballot boxes used and/or unused together with their contents in disputed polling units in the governorship election of Nasarawa state held on 11th day of April, 2015 for inspection is hereby granted”.
