Criminal Investigation and Intelligence Department, CID, of Lagos State Police Command, Panti-Yaba, yesterday, charged 21 year-old, Azeez Adejumobi, before a Lagos Chief Magistrate Court sitting at Ebute-metta, for allegedly stabbing his friend, late Saheed Ibitoye to death.
The accused was alleged to have stabbed the deceased on his left hand after an argument ensued between them.
Adejumobi, who resides at 4, Ajegunle St., Onipanu, Ilupeju, is being tried for unlawful kill.
The Prosecutor, Insp. Gbemileke Agoi, told the court that the accused allegedly committed the offence on Sept. 24 at 9. 00 p.m, along Abidogun St., Onipanu, Ilupeju.
According to Agoi, the duo got into a heated argument and in the process, the deceased picked up a cutlass but Adejumobi was quick to stab him on his left hand.
The offences Agoi said, contravened section 221 of the Criminal Laws of Lagos State, 2011.
However, the presiding Magistrate, Mrs. M. O. Olajuwon, declined to remand the accused, while turning down the murder charge levelled against him.
Magistrate Olajuwon said the accused ought to have been charged with manslaughter, since both the accused and deceased were said to have been in possession of dangerous weapons.
She consequently admitted bail to the accused in the sum of N500,000.00, with two sureties in the same like sum.
The Magistrate said; “Since they both had in their possessions dangerous weapons, I want to see the case as manslaughter and not a deliberate murder.
“The charge before me also reads unlawful kill and not murder, I hereby grant the accused bail in the sum of N500, 000 with two responsible sureties in like sum,” said the Magistrate.
After admitting bail to the accused, Olajuwon ordered that the case file be duplicated and sent to the Director of Public Prosecutions, DPP’s, for advice. While adjourned till Nov. 9 for advice.
