Misinterpretation of the verdict of the Supreme Court ruling on the internal affairs of Anambra state Peoples Democratic Party to the effect that Senators Andy Uba and Stella Odua, both from Anambra South and Anambra North Senatorial Districts of Anambra state respectively, were sacked from the Senate has been blamed on politicians and the media.
A constitutional lawyer, Prince Orji Nwafor-Orizu who stated this in Abuja was of the opinion that the case in question emanated from a Federal High Court, FHC, in Port Harcourt, when judges were on vacation as at the time of the case in Anambra. The FHC, according to him, gave an interlocutory order that Ejike Oguebego was the authentic party chairman in the state, which he accused the PDP of disobeying by creating a caretaker committee instead. He further explained that it was the earlier decision of the FHC in Port Harcout that was restored by the Supreme Court, maintaining that nobody was sacked by the court, neither was any person ordered to be sworn -in, nor a new chairman emerged in the state.
He stressed that it would be in error, if INEC should be preparing to give Certificate of Return or swear-in any other persons in place of Senators Andy Uba and Stella Odua, maintaining that the decision of the Supreme Court was that Ejike Oguebego-led PDP executives in the state were the authentic ones in Anambra. He further said that the court’s decision was neither based on who is the authentic PDP chairman in the state, nor who is the authentic person to represent the said zone at the Senate. By this verdict, Orizu opined that the PDP had no power to refuse court order.
He therefore advised that INEC should not withdraw certificate from anybody and give to another, saying that it is only a court of competent jurisdiction that has power to give order to that effect.
