Election Petition Tribunal sitting in Akure, the Ondo State capital, yesterday granted the order to serve the Peoples Democratic Party, PDP, and All Progressives Congress, APC, the petitions against some of their candidates by substituted means.
The three-man panel headed by Justice Anthony Ogar granted the order when lawyers to the PDP and APC, Dr Tunji Abayomi, Honourable Remi Olatubora and Charles Titiloye complained that the defendants in their petitions had been trying to evade service.
Titiloye had moved his applications for Ilaje constituencies 1 and 2, complaining that defendants in the petitions, Prince Abayomi Akinruntan and Coker Malachi had been evading service as required by law.
Consequently, he asked the tribunal to grant him the order to serve the petitions to the defendants through pasting them on the walls of their party secretariats along Oyemekun and Alagbaka Roads in Akure.
Also, Dr Abayomi who appeared with Prince Idowu Mafimisebi and Ayo Adedipe in his applications said the PDP candidates who had been declared winners of the election held in Idanre, Ondo West 1 and 11, and Ondo East state constituencies had been evading service in order to frustrate the hearing of the petitions.
He attached to the applications the affidavit deposed by the bailiff of the tribunal to the effect that he had not been able to effect service of the actual petitions on the defendants, thereby praying the court to grant the ex parte order for substituted service.
Similarity, Olatubora in his applications asked the tribunal to grant substituted service to the candidates of the APC who were declared winners of the April 11 House of Assembly election in their constituencies.
In his applications, Olatubora said the APC candidates had been evading service and the applications were necessary in order to meet the deadline for the conclusion of the petitions before the tribunal.
The constituencies, according to him, include Akoko Southwest constituency 1 and 11, Owo constituency 11, Akure South constituency 11 and Akoko Northwest constituency 1.
In its ruling, the tribunal granted the applications moved by the lawyers to both the PDP and APC, and asked the petitioners to either paste the petitions on the walls of their party secretariats or drop it with the secretaries of their parties.
