The All Progressives Congress, APC suit challenging the victory of Governor Ibrahim Dankwambo and the Peoples Democratic Party, PDP in the April 11 governorship election in Gombe state has been thrown out by the governorship elections tribunal sitting in the state capital.
The Justice Mohammed Sirajo-led panel in a four and half hour judgment delivered about 8:00pm yesterday, dismissed the case for lack of merit and insubstantial proof on the part of the petitioner.
He said the petitioners’ counsel failed to prove beyond doubts their allegations, some of which were criminal in nature.
The petitioner had alleged ballot box snatching, ballot stuffing, over-voting and falsification of figures.
“The responsibility to prove the allegation lies with the petitioner and was unable to prove his case beyond reasonable doubts.
“The petitioners’ counsel failed to prove adduce evidence that their client won by majority votes. The petitioner also failed to prove over-voting”, he said.
Abdulganiyu Bello, who held the brief of Adeniyi Akintola, SAN, said they were going to consult with their clients on the next way forward.
Counsel to Governor Dankwambo, Zubairu Umar said they were only waiting for the judgment because right from the onset, the petitioner had put up a weak case against their robust defence.
Representative of the Independent National Electoral Commission, INEC, Yahaya Dangana said they were happy with the judgement because it did not only vindicate them but showed that they did a good job also.
