Oyo State Governorship Election Petition Tribunal hearing the petition of Senator Rasidi Ladoja of the Accord Party against Oyo State governor, Senator Abiola Ajimobi, yesterday dismissed an application brought by Ladoja’s counsel, Richard Ogunwole, seeking a leave of the tribunal to call a forensic analyst, Dr. Babatunde Adegbola.
Chairman of tribunal, Justice Muhammed Aliyu Mayaki while delivering about an hour ruling, dismissed the application on the ground that the application was not brought during the pre-hearing session and no exparte order was sought.
The forensic analyst was the leader of the team that inspected and counted ballot papers and boxes used for the April 11, 2015, election in the state.
Though the petitioner made oral application requesting for the forensic expert, Justice Mayaki said such contradicted the provision of paragraph 47, subsection 1 of the First Schedule of the Electoral Act, 2010.
He described the application as an abuse of the court process.
According to Justice Meyaki, the report of the forensic analyst should have been tendered with that of the first witness, Mr Bimbo Adepoju, instead of bringing them piece meal.
Some of the other petitioners witnesses led in evidence at yesterday’s sitting were Mr Michael Olusola, Okunade Akorede, Adeleye Adewale, Ogunsola Olawale, and Amuda Dauda Ayanniwura.
