National and State Assembly Tribunal sitting in Gombe has upheld the election of the speaker of the state House of Assembly, Alhaji Nasiru Nono (Peoples Democratic Party, PDP), representing Yamaltu-Deba West constituency.
This is sequel to the tribunal’s dismissal of the petition filed by Malam Mohammed Saidu of the All Progressives Congress, APC, against Nono’s election as the representative of Yamaltu-Deba West constituency of the state House of Assembly.
Delivering the judgement in Gombe on Tuesday evening, chairman of the tribunal, Justice Roseline Audu said the petition was dismissed because the petitioners lacked enough evidence to prove their allegations.
She said the petitioners’ allegations of over voting, miscalculation of figures and rigging among others were not proven beyond reasonable doubt.
“The petitioners must provide enough evidence to prove their case beyond reasonable doubt and they failed to do so,” she said.
Commenting on the judgement, Malam Aliyu Usman Barde, counsel to the petitioners said he was not comfortable with the judgement but added that he would contact his clients for the next line of action.
Malam Abu Abdu, counsel to the first and second respondents, Nasiru Nono and PDP, extolled the tribunal for the judgement.
He said he believed that they defended the petition well based on what was on the ground and justice was done to all sides based on their presentations.
