National Assembly Election Tribunal, Enugu, has nullified the election of Senator Gilbert Nnaji (Enugu East) and ordered a rerun of the election in the zone.
The tribunal chairman, Justice Matthew Adewara, in his judgement, said that irregularities in the March 28 election in the zone made the result of the exercise difficult to accept as fair.
Doctor Chimaroke Nnamani of the People for Democratic Change, PDC, had gone to the tribunal to challenge the election of Senator Nnaji on the grounds that a lot of irregularities were part of the conduct.
He asked the tribunal to declare him winner of the election, since according to him, there were massive cheating and over voting
However the tribunal in its judgment held that there were over-voting in many places where the number of ballots returned out-numbered the voters accredited to vote.
The tribunal also upheld the petitioner’s claims that there were gross electoral misconducts in many booths making it difficult for the tribunal to discountenance the results.
The three-man tribunal headed by Justice Matthew O. Adewara ordered the election exercise to be repeated in due course on a date to be fixed by INEC.
Former Enugu State Governor, Senator Chimaroke Nnamani, the father of Ebeano, who ran under the People for Democratic Change, PDC, had petitioned against the declaration of Senator Nnaji of the PDP as the winner of the March 28, 2015 election, insisting that he won.
However, rather than declare an outright winner, the tribunal ordered a fresh election but no date was suggested.
Justice Adewara in the judgement, said that the election was marred by gross irregularities that included that the number of votes quite outweighed the number of accredited voters.
Adewara maintained that thorough investigation and evidence before the tribunal indicated that there were gross irregularities hence the cancellation of the election.
State chairman of PDC, Mr. Sunday Ani, in a reaction to the judgement, declared the judgment a land mark one, saying that the tribunal judges were not biased in their ruling.
He however claimed that Nnamani won the election and would win again if the election were to be contested ten times over.
“Even a year old baby knew that Chimaroke won the election. We are going to show Gil that he is nothing in Enugu,” Mr. Ani promised.
Nnamani supporters who had come in high hopes that he would be declared outright winner, all the same, went on jubilating and dancing along major streets singing former Governor Chimaroke’s praises.
A supporter of Senator Nnaji told Nigerian Pilot that Chimaroke supporters were jubilating in vain because” Nnaji would win again and again.”
